1. Allgemeines:

1.1  Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Dienstleistungen von Julia Haase (Elisa Bernschein Wellnessmassagen), nachfolgend „Anbieterin“ genannt, die in ihren Räumlichkeiten in der Corinthstraße 46, 10245 Berlin, angeboten werden.1.2 Abweichende Regelungen, Ergänzungen oder Nebenabreden bedürfen der schriftlichen Zustimmung der Anbieterin.

2. Leistungen

2.1  Die Anbieterin bietet verschiedene Massagedienstleistungen an, darunter, aber nicht ausschließlich, Wellness-Massagen, Deep-Tissue-Massagen und Handmassagen.

2.2 Das Angebot kann nach Ermessen der Anbieterin erweitert oder verändert werden. Kunden werden über Änderungen rechtzeitig informiert.

2.3 Dienstleistungen finden in den Räumlichkeiten der Anbieterin statt; Mobile Massagen werden separat besprochen und verhandelt

3. Terminvereinbarung

3.1 Termine können persönlich über das Kontaktformular auf der Website elisa-bernschein.com, einen externen Google-Kalender, telefonisch oder über externe Buchungsplattformen wie z.B. treatwell.de vereinbart werden.
3.2  Ein verbindlicher Termin kommt zustande, sobald die Anbieterin den Termin schriftlich oder mündlich bestätigt.

4. Zahlungsbedingungen

4.1 Die Zahlung erfolgt nach erbrachter Leistung vor Ort in bar, über eine genutzte Buchungsplattform oder per Rechnung.

4.2 Rechnungen sind innerhalb von 14 Tagen nach Rechnungsdatum ohne Abzug zu begleichen.

4.3 Bei Zahlungsverzug behält sich die Anbieterin vor, Verzugszinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz zu berechnen.

5. Stornierungs-& Verschiebungsbedingungen

5.1 Kunden können Termine bis zu 24 Stunden vor dem geplanten Termin kostenfrei stornieren oder verschieben.
5.2 Wird ein Termin innerhalb von weniger als 24 Stunden vor dem Termin abgesagt, stellt die Anbieterin den vollen Preis der gebuchten Massageleistung in Rechnung.

5.3 Ein Termin darf maximal einmal verschoben werden. Bei einer weiteren Absage oder Verschiebung wird eine Rechnung über die vereinbarte Dienstleistung gestellt.

6. Abonnementregelungen

6.1 Die Anbieterin bietet Abonnements in Form von Paketen an. Die Preisgestaltung ist im Abschnitt Preise einsehbar.
6.2  Kunden werden rechtzeitig über weitere Abonnement-Angebote und deren Bedingungen informiert.

7. Haftung und Disclaimer

7.1 Haftung: Die Anbieterin haftet nur für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung beruhen. Für gesundheitliche Risiken, die der Kunde verschweigt oder nicht ausreichend mitteilt, übernimmt die Anbieterin keine Haftung.

7.2 Haftungsausschluss: Massagen sind keine medizinische Behandlung und ersetzen keine ärztliche Beratung oder Therapie. Die Anbieterin übernimmt keine Haftung für gesundheitliche Beschwerden oder Risiken, die der Kunde vor Beginn der Massage nicht angegeben hat. Kunden sind verpflichtet, die Anbieterin vor der Massage über etwaige gesundheitliche Einschränkungen oder Vorerkrankungen (z. B. Schwangerschaft, Hauterkrankungen, akute Infektionen) zu informieren.

7.3 Verantwortung des Kunden:
Der Kunde trägt die Verantwortung für die Richtigkeit der Angaben und bestätigt, dass er körperlich in der Lage ist, die angebotenen Massagen ohne gesundheitliche Risiken zu empfangen. Sollte der Kunde während der Massage Unwohlsein verspüren, ist er verpflichtet, dies sofort der Anbieterin mitzuteilen.

8. Verarbeitung personenbezogener Daten (DSGVO)

8.1 Terminvereinbarung und Kontaktformular

  1. Die im Rahmen der Terminvereinbarung erfassten personenbezogenen Daten (z. B. Name, Telefonnummer, E-Mail-Adresse) werden ausschließlich zur Terminabwicklung und Kundenkommunikation genutzt.
  2. Die Anbieterin erhebt, speichert und verarbeitet personenbezogene Daten gemäß den geltenden Datenschutzbestimmungen der EU-Datenschutzgrundverordnung (DSGVO).
  3. Personenbezogene Daten werden nicht an Dritte weitergegeben, es sei denn, dies ist zur Erfüllung des Vertragsverhältnisses erforderlich oder gesetzlich vorgeschrieben.
  4. Kunden haben das Recht, jederzeit Auskunft über die gespeicherten Daten zu erhalten sowie deren Berichtigung oder Löschung zu verlangen.


8.2 Verarbeitung personenbezogener Daten im Anamneseformular

Wenn Sie mein Anamneseformular ausfüllen, erhebe und verarbeite ich personenbezogene Daten, um mögliche gesundheitliche Risiken im Zusammenhang mit der Massage zu vermeiden.

  2. Zweck der Verarbeitung: Die erhobenen Daten dienen ausschließlich der individuellen Beurteilung möglicher Kontraindikationen für eine Massagebehandlung, insbesondere im Zusammenhang mit bestimmten Vorerkrankungen oder Medikamenteneinnahmen.
  3. Rechtsgrundlage: Die Verarbeitung Ihrer Gesundheitsdaten erfolgt auf Grundlage Ihrer ausdrücklichen Einwilligung gemäß Art. 6 Abs. 1 lit. a, Art. 9 Abs. 2 lit. a DSGVO. Sie können Ihre Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen.
  4. Speicherdauer: Die Daten werden nur so lange gespeichert, wie es für die Beurteilung der Massageverträglichkeit erforderlich ist, maximal jedoch für 6 Monate. Danach werden sie gelöscht, sofern keine gesetzlichen Aufbewahrungspflichten entgegenstehen.
  5. Empfänger der Daten: Die über das Formular erhobenen Daten werden ausschließlich durch mich verarbeitet und nicht an Dritte weitergegeben. Das Anamneseformular wird über den Hosting-Dienstleister IONOS SE bereitgestellt, mit dem ich einen Auftragsverarbeitungsvertrag (AVV) abgeschlossen habe. Eine Datenverarbeitung findet ausschließlich auf Servern innerhalb der EU statt.
  6. Ihre Rechte: Sie haben das Recht auf Auskunft, Berichtigung, Löschung, Einschränkung der Verarbeitung sowie Datenübertragbarkeit. Zudem haben Sie das Recht, eine erteilte Einwilligung jederzeit zu widerrufen. Bitte wenden Sie sich dazu an die oben genannte verantwortliche Stelle.
  7. Sicherheit der Datenübertragung: Die Datenübertragung über meine Website erfolgt verschlüsselt (SSL/TLS). Falls Sie nicht möchten, dass Ihre Daten online übermittelt werden, haben Sie die Möglichkeit, das Anamneseformular vor Ort auszufüllen.


8.3 Hinweis zur Nutzung von Google Kalender für die Terminbuchung

Ich biete Ihnen die Möglichkeit, Termine über Google Kalender zu buchen. Hierbei werden Sie auf eine externe Seite weitergeleitet, die von Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland betrieben wird.

  1. Empfänger der Daten: Falls Sie den bereitgestellten Link zu Google Kalender nutzen, erfolgt die Verarbeitung personenbezogener Daten direkt durch Google als eigenständig Verantwortlichen. Google kann dabei Daten auf Servern außerhalb der EU speichern. Weitere Informationen zur Datenverarbeitung durch Google finden Sie in der Datenschutzerklärung von Google.
  2. Alternative Terminbuchung: Falls Sie keine Daten an Google übermitteln möchten, können Sie Ihren Termin alternativ per Telefon oder WhatsApp vereinbaren.


8.4 Hinweise zu Datenschutzbestimmungen
Die Daten werden gemäß den DSGVO-Richtlinien erfasst, verarbeitet und gespeichert, um Ihnen die Dienste anzubieten, zu verbessern und rechtlichen Verpflichtungen nachzukommen. 9. Gutscheine

9.1 Gutscheine können direkt bei der Anbieterin erworben werden. Eine Barauszahlung oder Rückerstattung ist ausgeschlossen.
9.2 Gutscheine sind ab Kaufdatum für 12 Monate gültig.

10. Vertraulichkeit

10.1 Die Anbieterin verpflichtet sich, alle im Rahmen der Dienstleistung bekannt gewordenen Informationen über den Kunden vertraulich zu behandeln.

11. Änderung der AGB

11.1 Die Anbieterin behält sich das Recht vor, diese AGB jederzeit zu ändern oder zu ergänzen.
11.2 Änderungen werden den Kunden in geeigneter Weise, insbesondere durch Veröffentlichung auf der Website, mitgeteilt.

12. Anwendbares Recht und Gerichtsstand

12.1 Es gilt das Recht der Bundesrepublik Deutschland.
12.2 Gerichtsstand ist der Sitz der Anbieterin, sofern der Kunde Kaufmann, juristische Person des öffentlichen Rechts oder öffentlich-rechtliches Sondervermögen ist.

13. Salvatorische Klausel

13.1 Die Unwirksamkeit einer oder mehrerer Bestimmungen in diesen AGB berührt nicht die Wirksamkeit der anderen Bestimmungen.
13.2 Soweit Bestimmungen nicht Vertragsbestandteil geworden oder unwirksam sind, richtet sich der Inhalt des Vertrags nach den gesetzlichen Vorschriften.

The Provider offers various massage services, including, but not limited to, wellness massages, deep tissue massages and hand massages. With each massage, the offer is made to address the senses separately. This can be utilised at the client's request or vary in intensity. The offer can be extended or changed at the discretion of the provider. Customers will be informed of any changes in good time. No mobile massages are offered; all services take place at the Provider's premises.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ( "DNT" ) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized .
