1. General:
1.1 These General Terms and Conditions (GTC) apply to all services provided by Elisa Bernschein (Julia Haase), hereinafter referred to as the "provider", which are offered in her premises at Corinthstraße 46, 10245 Berlin. 1.2 Deviating regulations, additions or ancillary agreements require the written consent of the provider.
2. Services
2.1 The provider offers various massage services, including, but not limited to, wellness massages, deep tissue massages and hand massages. 2.2 The offer can be expanded or changed at the discretion of the provider. Customers will be informed of changes in a timely manner. 2.3 No mobile massages are offered; all services take place on the provider's premises.
3. Appointment
3.1 Appointments can only be made in person using the contact form on the website elisa-bernschein.com or by telephone. 3.2 A binding appointment is made as soon as the provider confirms the appointment in writing or verbally.
4. Terms of payment
4.1 Payment is made on site in cash or by invoice after the service has been provided. 4.2 Invoices must be paid within 14 days of the invoice date without deductions. 4.3 In the event of late payment, the provider reserves the right to charge interest on arrears amounting to 5 percentage points above the respective base interest rate.
5. Cancellation & postponement conditions
5.1 Customers can cancel or reschedule appointments free of charge up to 24 hours before the scheduled appointment. 5.2 If an appointment is cancelled less than 24 hours before the appointment, the provider will invoice the full price of the booked massage service. 5.3 An appointment may be rescheduled a maximum of once. If the appointment is cancelled or rescheduled again, an invoice will be issued for the agreed service.
6. Subscription regulations
6.1 The provider does not currently offer any subscriptions. Should a subscription model be introduced in the future, this will be regulated separately in the terms and conditions. 6.2 Customers will be informed in good time about future subscription offers and their conditions.
7. Liability
7.1 The provider is only liable for damages that are based on an intentional or grossly negligent breach of duty. 7.2 The provider assumes no liability for health risks that the customer conceals or does not adequately disclose. 7.3 Customers are obliged to inform the provider of any existing health restrictions or complaints before the massage begins.

8. Data Protection (GDPR)
8.1 The personal data collected when making an appointment (name, telephone number, email address, etc.) are used exclusively for appointment processing and customer communication.8.2 The provider collects, stores and processes personal data in accordance with the applicable data protection provisions of the EU General Data Protection Regulation (GDPR).8.3 Personal data will not be passed on to third parties unless this is necessary to fulfill the contractual relationship or is required by law.8.4 Customers have the right to receive information about the stored data at any time and to request that it be corrected or deleted.
9.1 Vouchers can be purchased directly from the provider. Cash payment or refunds are excluded. 9.2 Vouchers are valid for 12 months from the date of purchase.
10.1 The provider undertakes to treat all information about the customer that becomes known in the context of the service as confidential.
11. Changes to the Terms and Conditions
11.1 The provider reserves the right to change or supplement these terms and conditions at any time.11.2 Changes will be communicated to the customer in an appropriate manner, in particular by publication on the website.
12. Applicable law and place of jurisdiction
12.1 The law of the Federal Republic of Germany applies.12.2 The place of jurisdiction is the registered office of the provider, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.
